Due to the lives that are often put at risk when intoxicated drivers get on the road, charges of DUI are not taken lightly and will be penalized to the full extent of the law. For first and second offenses of this crime, it is considered a misdemeanor and will be tried at the local municipal court, where the penalties will not be as severe as if it was a felony tried at the state level.

For first time DUI offenses, there is a minimum imprisonment of 48 hours (or 100 hours of community service), with the possibility of up to six months spent in jail. There is also the chance you will be faced with a monetary fine anywhere from $500 to $1,000. Your normal driving privileges will be suspended for 30 days, followed by 330 days of restricted privileges allowing you to drive only to and from work. Your vehicle can be impounded for up to a full year.

On the other hand, for a second offense, the stay in prison will run anywhere from 90 days to a year; beyond that, you will also face a fine of anywhere from $1,000 to $1,500. A successful conviction will lead to your driving privileges being suspended for a year, returned only with the condition that you must drive a vehicle with an ignition interlock device for the following year. Again, your vehicle can be impounded for a possible year.

What is the Diversion Program?

If this is your first DUI offense, and your DUI did not conclude in an accident, personal injury or wrongful death, then you could possibly be eligible for what is known as a DUI diversion program. If you enter into this program, you will have the chance to avoid a DUI conversion, however, the diversion will remain on your record to be used against you in the case of future DUI offenses. After entering into the diversionary program, there will be several terms and conditions that you will have to abide by. For example, you must not violate the law, you must not consume alcohol of any kind, and you must complete the alcohol classes. There will also be testing for drugs and alcohol, along with monthly meetings. If you fail to meet these terms, your case will be put back on track for conviction and imprisonment.
