Awarding Maintenance in Kansas

In Kansas, the court may decide to award maintenance (alimony) to either spouse in an amount the court deems to be fair and equitable under the circumstances.

A judge may order regular monthly payments, periodic payments, payments on a percentage of earnings, or a lump sum payment; however, the court is limited to ordering maintenance to no longer than 121 months. In some circumstances, this may be extended.

The court has the discretion to modify future payments unless the decree specifically states that it cannot. Similar to back child support payments, the court will not modify past due maintenance payments.
